These Terms of Service ("Terms") govern your access to and use of EdPathway, including the EdPathway website at https://edpathway-991u.onrender.com, related applications, parent and student accounts, activity-planning tools, checklists, document-management features, calendars, parent groups, educational resources, paid features, and other services we provide (collectively, the "Service").

EdPathway is owned and operated by Wonksknow LLC, which also operates YoungWonks. In these Terms, "EdPathway," "Wonksknow," "we," "us," and "our" refer to Wonksknow LLC and its applicable affiliates. "You" and "your" refer to the parent, legal guardian, or other adult who creates or uses an EdPathway account. A "Student" is a child aged 13 or older whose profile or login is created and authorized by a parent or guardian.

By creating an account, accessing the Service, creating a Student profile or login, joining a group, connecting an external calendar, purchasing a paid feature, uploading a document, or otherwise using the Service, you agree to these Terms and the EdPathway Privacy Policy. If you do not agree, do not use the Service.

1. Purpose of EdPathway

EdPathway is an educational planning and organizational platform intended to help parents and their high-school-age children discover, evaluate, organize, and prepare for educational and extracurricular activities.

Activities may include:

  • Mathematics, science, coding, engineering, and robotics competitions;
  • Research programs, internships, and academic enrichment opportunities;
  • Volunteer, scholarship, award, and college-preparation opportunities;
  • Application, registration, and event deadlines; and
  • Other educational or extracurricular activities.

Parents may select activities from the EdPathway activity database or create their own activities. Selected activities may appear on a Student’s EdPathway calendar and, at the parent’s direction, may be synchronized with an external calendar service.

EdPathway may make educational resources available in one or more ways. Depending on the resource, it may be hosted or delivered directly within EdPathway, embedded from another service, provided by YoungWonks (another service operated by Wonksknow LLC), provided by another Wonksknow service, licensed from an independent provider, made available without a separate login, or linked to an external website, registration page, purchase page, or trial-scheduling page.

Parents and Students may create checklists, tasks, target dates, completion statuses, notes, and consolidated planning views. Where available, users may attach documents to activities, checklist items, or tasks and manage those documents through EdPathway.

Certain plans may include email reminders or other notifications concerning registrations, applications, events, checklist tasks, and activity-related dates.

EdPathway is an informational, organizational, and planning tool. Unless expressly stated otherwise, it is not the official organizer, administrator, certifying organization, admissions authority, research institution, scholarship provider, or resource provider for an activity or external service.

2. Eligibility and Age Requirements

You must be at least 18 years old and legally capable of entering into a binding agreement to create a parent account.

EdPathway is intended for parents and legal guardians managing educational activities for children who are at least 13 years old. You represent and warrant that:

  1. You are the parent, legal guardian, or otherwise legally authorized adult responsible for each Student whose profile you create;
  2. Each Student for whom you create a profile or login is at least 13 years old;
  3. You have authority to provide the Student’s information and authorize the Student’s use of EdPathway;
  4. The information you provide is accurate and current; and
  5. Your use of the Service complies with applicable law.

EdPathway is not intended for children under 13. You may not create a Student profile or login for a child under 13. If we learn that information about a child under 13 was submitted, we may suspend the account and delete the associated information, subject to applicable law.

3. Parent and Student Accounts

3.1 Parent control and responsibility

The parent or guardian who creates the account is the primary account holder. The parent is responsible for creating and managing Student profiles and logins, selecting activities, managing checklist and document settings, deciding whether to join parent groups, configuring calendar integrations and reminders, reviewing Student use, and protecting account credentials.

A parent may create profiles for more than one eligible Student. Student access is provided under the parent’s authorization and supervision. The parent remains responsible for the Student’s use of the Service, including content submitted, documents uploaded, communications sent, and interactions with other users.

3.2 Account credentials and security

You must maintain the confidentiality of account credentials and must not allow unauthorized persons to access your account. Promptly notify us at support@wonksknow.com if you believe credentials have been compromised, an unauthorized profile has been created for your child, or someone is impersonating you or your child.

3.3 Transition at adulthood

When a Student reaches age 18, we may provide a process for transferring control of the Student profile, obtaining updated consent, separating the profile from the parent account, or closing the Student account. We may require identity or age verification before completing a transition.

4. Activity Information, Dates, and Deadlines

EdPathway may provide activity names, descriptions, eligibility requirements, recommended ages or grade levels, registration and application dates, event dates, fees, locations, requirements, preparation suggestions, links, and related resource listings.

We attempt to provide useful information, but activity information may be incomplete, outdated, incorrectly entered, or changed without notice. Organizers may change eligibility, deadlines, fees, rules, locations, formats, availability, selection procedures, or cancellation terms. Information may also be entered or modified by users, and EdPathway may not independently verify every activity, resource, deadline, checklist item, or user-created entry.

You are responsible for verifying all material information directly with the official organizer or provider before registering, applying, paying a fee, purchasing a resource, scheduling a trial, making travel arrangements, attending an event, or relying on a deadline.

EdPathway does not guarantee:

  • That information is complete, accurate, or current;
  • That an activity or resource will remain available;
  • That a displayed date is the organizer’s official or current date;
  • That a Student is eligible or will be accepted, selected, admitted, qualified, or awarded;
  • That a registration, application, purchase, or trial request will be completed successfully;
  • That participation or use of a resource will improve any academic, competition, research, scholarship, admissions, or career outcome; or
  • That EdPathway will identify every change, postponement, or cancellation.

5. User-Created Activities, Checklists, Tasks, and Notes

Parents and Students may be permitted to add their own activities, deadlines, checklist items, tasks, target dates, completion statuses, notes, links, descriptions, and related information. EdPathway may display dates from multiple checklists or activities in an aggregated or consolidated planning view.

The consolidated view is provided for convenience. It may not display every date, may not reflect external changes, and should not be treated as an official calendar or authoritative deadline source.

You are responsible for verifying information you enter, reviewing activity and checklist dates, updating changed dates, marking tasks complete, removing obsolete tasks, confirming official deadlines, and maintaining an independent backup or alternative planning system for important deadlines.

You must not add content that infringes rights, contains malicious code or deceptive links, is unlawful or abusive, discloses confidential information without authorization, falsely claims affiliation, impersonates another person or organization, or is intended to mislead users about an opportunity or deadline.

6. Educational Resources

EdPathway may host, deliver, embed, display, recommend, license, or link to educational resources. A resource may be included in a free or paid plan, offered as a separate purchase, provided by EdPathway or YoungWonks, provided by another Wonksknow service, licensed from an independent provider, hosted by EdPathway but owned by another party, embedded from another service, or available only through an external website or application.

The applicable resource card, page, access flow, call-to-action button, or purchase page may identify the provider, whether the resource is free or paid, material access requirements, plan limitations, and separate terms. The presence of a resource within EdPathway does not necessarily mean it is included in the user’s current plan or that the provider paid EdPathway for inclusion.

6.1 EdPathway-hosted resources

Unless otherwise stated, access to a resource hosted or delivered through EdPathway is for the personal educational use of the parent and authorized Students associated with the account. You may not reproduce, republish, sell, sublicense, commercially distribute, share restricted resources with unauthorized persons, circumvent access controls, remove proprietary notices, use automated systems to extract substantial content, or use the resources to build a competing product or service.

Access may be limited by plan, account, time period, usage limit, license restriction, or other conditions displayed within the Service. We may modify, replace, suspend, or discontinue a resource. When reasonably practical, we will provide notice before materially discontinuing a resource purchased for a specifically stated access period.

6.2 YoungWonks and other Wonksknow resources

YoungWonks and EdPathway are both operated by Wonksknow LLC. EdPathway may display free or paid YoungWonks resources alongside free or paid resources offered by independent third parties. A YoungWonks listing will identify YoungWonks as the provider and will indicate when payment, enrollment, or a separate account is required. Wonksknow LLC may financially benefit when a user purchases or enrolls in a YoungWonks resource. EdPathway does not represent a YoungWonks listing as an independent third-party recommendation.

A YoungWonks listing need not be labeled “Sponsored” or “Advertisement” solely because YoungWonks is another service operated by Wonksknow LLC. If a YoungWonks resource receives special promotional prominence beyond ordinary relevance-based placement, EdPathway will use a clear label such as “Promoted,” “Featured YoungWonks resource,” or another description appropriate to the presentation. Separate YoungWonks terms, privacy policies, prices, enrollment requirements, trial conditions, cancellation rules, and refund policies may apply. A YoungWonks resource is not included in an EdPathway plan merely because it is displayed or recommended unless the applicable plan or resource page expressly states that it is included.

6.3 Third-party resources and external services

Some resources may be owned, hosted, licensed, administered, or delivered by independent third parties. A third-party resource may be free or may require payment to the provider. Unless the listing states otherwise, the fact that a third-party resource is displayed does not mean the provider paid EdPathway for inclusion.

EdPathway may link to the third party, embed the third party’s content or service, host licensed third-party content, facilitate access, or display information supplied by the provider. If a provider pays for enhanced visibility, sponsors a listing, or participates in an affiliate, lead-generation, referral, revenue-sharing, or similar arrangement, EdPathway will use an appropriate disclosure in or near the listing, such as “Sponsored,” “Promoted,” “Paid placement,” “Affiliate link,” or “Referral relationship.”

Unless expressly stated otherwise, inclusion, description, ranking, recommendation, embedding, hosting, or display does not mean EdPathway guarantees the resource’s accuracy, quality, legality, safety, suitability, provider qualifications, continued availability, trial availability, registration acceptance, price, or educational result. When you access an external website or service, the external provider’s terms and privacy policy govern. Any external registration, trial, purchase, subscription, cancellation, refund, communication, or dispute is between you and the provider unless EdPathway expressly states otherwise.

6.4 Resource selection, ordering, and labels

EdPathway may select, personalize, organize, or order resources based on factors such as the activity being viewed, parent registration information, Student age or grade, stated interests, activities viewed, saved, or added, resource interactions, location, availability, quality considerations, contractual arrangements, and business considerations. A resource’s position does not necessarily mean that it is the best, least expensive, most popular, or most suitable option, and EdPathway may not list every available resource.

The label “Paid resource” means that a user may have to pay to access or purchase the resource; it does not mean that the provider paid EdPathway for placement. “Sponsored,” “Promoted,” or “Paid placement” indicates that compensation or another commercial arrangement may have influenced the resource’s visibility or placement. “Affiliate link” or “Referral relationship” indicates that EdPathway or Wonksknow LLC may receive compensation if a user clicks, registers, schedules a trial, enrolls, or purchases.

Resource labels and disclosures are intended to help users understand the provider, user cost, and any material commercial relationship. Users should evaluate resources independently and review the provider’s terms, privacy practices, prices, and refund policies.

7. Calendars, Checklists, and Reminders

EdPathway may display selected activities, registration and application dates, event dates, checklist tasks, target dates, completion statuses, and consolidated views of dates. These features are organizational tools, not official calendars maintained by an activity organizer or provider.

7.1 External calendar integrations

EdPathway may allow a parent to connect Google Calendar or another external calendar. Integration is optional. When you connect a calendar, you authorize EdPathway to use the permissions presented during the connection process, which may allow EdPathway to create, update, or remove events associated with EdPathway activities.

Unless expressly indicated, checklist items and checklist dates are not necessarily synchronized merely because activity-calendar synchronization is enabled. You are responsible for selecting the correct calendar, reviewing synchronized events, confirming official dates, correcting inaccuracies, avoiding duplicates, managing external notifications, and disconnecting the integration when no longer desired.

Activity information may change after synchronization. EdPathway does not guarantee that every external change will update an activity listing, checklist, consolidated view, external calendar event, or email reminder. Deleting an activity from EdPathway may or may not remove an external event, and deleting an external event may not remove the corresponding EdPathway item.

7.2 Email and other reminders

Depending on your plan and settings, EdPathway may offer optional reminders concerning registrations, applications, events, checklist tasks, incomplete tasks, or other dates. You may need to enable or configure reminder features.

Reminders are a convenience and supplementary planning tool, not an official notice. EdPathway does not guarantee that a reminder will be created, sent, delivered, delivered only once, delivered at a particular time, delivered sufficiently in advance, reach the intended recipient, avoid spam filtering, contain current information, or reflect a recent organizer change.

A reminder may fail because of technical errors, inaccurate contact information, user settings, third-party outages, filtering, account restrictions, changed deadlines, or other causes. You remain responsible for independently tracking and verifying all registrations, applications, events, deadlines, and checklist tasks, regardless of whether you use a free or paid plan.

8. Parent Groups and Community Features

When a parent adds an activity, EdPathway may offer the parent an opportunity to join a group with other parents whose children are participating in or considering the same activity. Joining is optional.

Before joining, EdPathway may identify what information is visible to other members. Depending on settings, this may include the parent’s display name, profile image, the associated activity, voluntarily posted content, and limited Student information such as a first name, initial, age range, or grade level when the parent expressly chooses to make it visible.

Do not post a child’s home address, exact daily schedule, personal phone number, financial information, government identifiers, medical information, private school records, precise real-time location, travel details creating a safety risk, or other unnecessary sensitive information.

EdPathway does not guarantee the identity, qualifications, intentions, accuracy, or conduct of other members. Use caution before communicating outside EdPathway, meeting in person, sharing contact information, exchanging money, or arranging transportation. Parents are solely responsible for supervising interactions involving their children.

8.1 Community conduct

You may not use groups or community features to harass, threaten, discriminate, share inappropriate material, solicit personal information from minors, impersonate others, promote scams, send spam, collect member information for commercial purposes, disclose private information without permission, arrange unsafe or unlawful activity, scrape member information, circumvent moderation, or violate law.

We may review, remove, restrict, or preserve community content when reasonably necessary to operate the Service, investigate a complaint, protect users, enforce these Terms, or comply with law. We are not obligated to monitor every communication.

8.2 Leaving or removal from groups

You may leave a group using available controls. We may remove a user or suspend community access for violations, safety concerns, repeated complaints, or conduct that interferes with the group’s purpose.

9. User Content and Uploaded Documents

"User Content" means information or material submitted, created, stored, or uploaded through the Service, including activity descriptions, checklist items, dates, completion statuses, notes, messages, comments, links, images, feedback, and uploaded documents.

9.1 Ownership and authority

You retain ownership of your User Content and uploaded documents. Uploading a document does not transfer ownership to us. You represent and warrant that you own the content or have authority to upload and use it; that uploading it does not violate copyright, privacy, confidentiality, contractual, or other rights; that you have authority to upload information about your child; and that any required consent for information about another person has been obtained.

9.2 Limited license

You grant EdPathway and Wonksknow LLC a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, process, transmit, display, retrieve, download, back up, and otherwise use User Content only as reasonably necessary to provide the Service, associate content with an account, Student, activity, checklist, or task, allow authorized access, generate previews where supported, maintain backups, detect harmful or prohibited files, provide support, protect users, enforce these Terms, and comply with law.

This license does not permit us to sell the contents of private documents or use them for targeted advertising. It ends when the content is deleted from active systems, except that copies may remain temporarily in backups, security logs, or legally required records.

9.3 Privacy, sharing, and visibility

Uploaded documents are private to the applicable account by default unless the Service clearly provides a sharing feature and the user deliberately chooses to share. Before sharing, review the recipients and permissions. Do not upload or share unnecessary sensitive information, including Social Security numbers, passport or government-identification numbers, financial-account information, payment-card information, passwords, detailed medical records, biometric information, immigration documents, confidential recommendation letters not intended for the user, or precise location and travel information that creates a safety risk.

9.4 File restrictions and security

We may establish limits concerning file types, sizes, storage, number of documents, filenames, upload frequency, and retention periods. We may scan, inspect, quarantine, reject, restrict, disable, or remove a file that contains malware or harmful code, violates these Terms or law, infringes rights, creates a safety or privacy risk, interferes with the Service, exceeds limits, or is otherwise harmful or inappropriate. We are not obligated to inspect every document and do not guarantee that scanning will detect every threat.

9.5 Availability, backups, and deletion

The document-management feature is a convenience and is not intended to be the sole permanent archive, official records repository, or backup location for important documents. You must retain original or backup copies outside EdPathway.

We do not guarantee that every upload will succeed, every document will remain available, previews will display accurately, formatting will be preserved, deleted or replaced files can be recovered, files will be compatible with every device, or storage will be uninterrupted or indefinite.

Users may delete documents using available controls. Deleting an activity, checklist, task, or Student profile may also delete associated documents, or the interface may require separate deletion. Deleted documents may remain temporarily in backups or restricted technical systems. We may retain a document or related record where reasonably necessary for law, security, dispute resolution, enforcement, or user protection.

10. Acceptable Use

You may use EdPathway only for lawful personal, family, and educational-planning purposes. You may not:

  1. Access another person’s account without authorization or create a false identity;
  2. Misrepresent your relationship to a child or create a profile without authority;
  3. Scrape, copy, export, or republish substantial portions of the activity, resource, user, or group databases;
  4. Reverse engineer the Service except where legally permitted;
  5. Interfere with security, operation, or availability, upload harmful code, or test vulnerabilities without written authorization;
  6. Circumvent access controls, payment requirements, storage limits, or usage limits;
  7. Use the Service to advertise, solicit, surveil, harass, discriminate, profile minors, or collect information about users without authorization;
  8. Upload content that is unlawful, sexually exploitative, violent, abusive, fraudulent, stolen, falsified, or intended to deceive an institution, organizer, scholarship provider, or other person;
  9. Upload another person’s educational, financial, medical, identification, or confidential records without authorization;
  10. Violate intellectual-property, privacy, publicity, confidentiality, contractual, or other rights; or
  11. Help another person engage in prohibited conduct.

These acceptable-use rules are part of these Terms. EdPathway may also publish plain-language Community Guidelines or safety guidance. Any such guidance supplements, but does not replace, these Terms.

11. Free and Paid Plans

EdPathway may offer a free version, optional paid plans, paid features, one-time purchases, subscriptions, premium planning tools, reminder features, hosted resources, storage upgrades, or other services. Availability and limits may vary by plan.

The purchase page will identify the represented features, price, billing period, renewal terms, cancellation process, and applicable refund terms. Payment provides access to the applicable functionality, subject to these Terms. Payment does not purchase or create any guarantee concerning information accuracy, resource availability, registration success, eligibility, acceptance, reminder delivery, calendar synchronization, document availability, prevention of missed deadlines, or any educational result.

Free and paid versions are subject to the same information-accuracy, availability, reminder-delivery, document-storage, warranty, and liability disclaimers in these Terms.

11.1 Subscriptions and recurring billing

If a feature is offered as a recurring subscription, the purchase screen will disclose the price, billing frequency, automatic-renewal status, cancellation method, effective date of cancellation, and trial or promotional terms. By purchasing an automatically renewing subscription, you authorize recurring charges until cancellation.

11.2 Price and feature changes

We may change prices for future purchases or subscription periods and may modify plan features. For existing recurring subscriptions, we will provide notice of material price changes as required by law. Where reasonably practical, we will provide notice before materially reducing an active paid plan.

11.3 Payments and refunds

You authorize us and our payment processor to charge the payment method provided. We do not ordinarily receive or store complete payment-card numbers. Unless otherwise stated, payments are nonrefundable except where required by law. A missed reminder, failed synchronization, unavailable resource, failed document upload, or other feature failure does not automatically create a right to a refund. Nothing limits rights that cannot legally be waived.

12. Communications

By creating an account, you agree to receive service-related communications, including account verification, security alerts, calendar and reminder notices, group notifications, changes to the Service or policies, payment receipts, and support messages.

Where permitted by law, we may send parents information about EdPathway, YoungWonks, Wonksknow, educational resources, or related services. You may unsubscribe from promotional emails using the unsubscribe link. You may continue to receive non-promotional messages necessary to operate the account or requested features.

13. Privacy

Our collection and use of personal information are described in the EdPathway Privacy Policy. By creating a Student profile, you confirm that you have authority to provide the Student’s information and authorize its processing. Do not provide information that is unnecessary for the Service, including government identifiers, financial-account credentials, detailed medical records, or other highly sensitive information.

14. Ownership and Intellectual Property

The Service and its original software, design, interfaces, databases, trademarks, logos, graphics, organization, and functionality are owned by or licensed to Wonksknow LLC and protected by law. This includes EdPathway-created activity and resource descriptions, preparation guides, articles, videos, graphics, calendar tools, checklist tools, document-management tools, and compilations and arrangements of information.

Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable license to access and use the Service for family educational-planning purposes. This license does not permit commercial exploitation, republication of the database, removal of proprietary notices, creation of a competing database, unauthorized use of trademarks, or copying and distribution beyond what law permits.

Third-party names, logos, resources, and trademarks remain the property of their respective owners.

15. Feedback

You may provide suggestions, ideas, or feedback. You grant us the right to use feedback without restriction or compensation, provided we do not publicly identify you as the source without permission.

16. Changes to the Service

We may add, modify, suspend, or discontinue features, activities, resources, groups, calendar integrations, reminders, document-management functions, and paid features. We are not liable for changes made by independent organizers, providers, Google, payment processors, storage providers, or other third parties. Where reasonably practical, we will provide notice before discontinuing a material paid feature.

17. Account Suspension and Termination

You may stop using EdPathway at any time and may request account deletion through available settings or by contacting us. We may restrict, suspend, or terminate an account if we reasonably believe these Terms were violated, information is false, a child is under the permitted age, a user presents a safety or security risk, harassment or fraud occurred, payment remains unpaid, legal compliance requires action, or continued access could harm EdPathway or another person.

When appropriate, we may provide notice and an opportunity to appeal. We may act without advance notice for safety, fraud, security, or legal concerns. Sections that by their nature should survive termination remain effective, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDPATHWAY AND ALL FREE AND PAID PLANS, FEATURES, CONTENT, ACTIVITY INFORMATION, RESOURCE LISTINGS, LINKS, CHECKLISTS, CONSOLIDATED DATE VIEWS, CALENDARS, REMINDERS, EMAILS, GROUPS, DOCUMENT-MANAGEMENT FEATURES, INTEGRATIONS, AND OTHER SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PAYMENT OF A FEE DOES NOT CREATE A WARRANTY OR GUARANTEE THAT WOULD NOT OTHERWISE APPLY.

WONKSKNOW LLC AND ITS AFFILIATES DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, SECURITY, AND RESULTS.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free;
  • Activity, resource, checklist, calendar, deadline, or reminder information will be complete, accurate, or current;
  • An activity or resource will remain available;
  • A user will successfully register, apply, enroll, purchase, or schedule a trial;
  • A calendar event, checklist date, consolidated view, email, or reminder will be created, displayed, sent, received, or timely;
  • A document will be successfully uploaded, stored, displayed, downloaded, synchronized, or recovered;
  • Document formatting, metadata, or content will be preserved without error;
  • Security scanning will identify every harmful file;
  • A document will be suitable for submission to an organizer, institution, or third party;
  • External links, providers, resources, or services will be safe, accurate, suitable, or available;
  • Community members will act appropriately;
  • Defects will be corrected; or
  • Use of a free or paid plan will produce any particular educational, competition, research, scholarship, admissions, or career outcome.

YOU ARE RESPONSIBLE FOR VERIFYING ALL MATERIAL DATES, DEADLINES, ELIGIBILITY REQUIREMENTS, FEES, RULES, LOCATIONS, SAFETY CONDITIONS, AND OTHER INFORMATION DIRECTLY WITH THE APPLICABLE ORGANIZER OR PROVIDER. DO NOT RELY EXCLUSIVELY ON EDPATHWAY, A CHECKLIST, A CONSOLIDATED DATE VIEW, AN EXTERNAL CALENDAR, AN EMAIL REMINDER, OR EDPATHWAY DOCUMENT STORAGE FOR AN IMPORTANT DEADLINE, EVENT, OR DOCUMENT.

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WONKSKNOW LLC, EDPATHWAY, YOUNGWONKS, THEIR AFFILIATES, AND THEIR RESPECTIVE OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

This includes losses arising from:

  • Missed registration, application, event, competition, trial, or appointment deadlines;
  • A reminder, email, notification, calendar event, checklist item, or consolidated view that was inaccurate, late, duplicated, or not created or delivered;
  • Inaccurate or outdated activity information;
  • Calendar or synchronization failures;
  • External resource links, third-party content, products, services, conduct, registrations, purchases, cancellations, or refunds;
  • Community interactions;
  • Loss, corruption, alteration, unavailability, or unauthorized disclosure of data or documents;
  • Failure to retain an independent document backup;
  • Submission of an outdated, incomplete, incompatible, or incorrect document;
  • Unauthorized account access or interruption of service;
  • A Student’s participation in an external activity; or
  • Reliance on information or features provided through EdPathway.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EDPATHWAY DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED UNITED STATES DOLLARS.

These limitations apply to free and paid users, regardless of legal theory and even if damages were foreseeable. Nothing excludes liability that cannot legally be excluded, including liability for fraud, willful misconduct, or other nonwaivable liability.

20. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Wonksknow LLC, EdPathway, YoungWonks, their affiliates, and their respective officers, directors, employees, contractors, and agents from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your or your Student’s violation of these Terms, User Content, uploaded documents, lack of authority to create a profile or upload information, violation of another person’s rights, community conduct, misuse of information, or violation of law. This does not apply to the extent a claim results from our gross negligence, willful misconduct, or violation of law.

21. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

21.1 Informal resolution

Before filing a formal claim, the initiating party must send written notice describing the account holder, facts, requested resolution, and supporting information. Notices to Wonksknow LLC must be sent to legal@wonksknow.com and the mailing address in Section 25. The parties will have 30 days after receipt to attempt informal resolution.

21.2 Binding individual arbitration

Except for eligible small-claims matters and requests for temporary or preliminary injunctive relief involving intellectual property, unauthorized access, or misuse of the Service, disputes arising from these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The Federal Arbitration Act governs this provision.

21.3 No class or representative proceedings

YOU AND WONKSKNOW LLC AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY. NEITHER PARTY MAY PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION OR ARBITRATION.

21.4 Small-claims court

Either party may bring an individual claim in a small-claims court of competent jurisdiction if the claim qualifies.

21.5 Arbitration opt-out

You may opt out of arbitration by sending written notice to legal@wonksknow.com within 30 days after first accepting these Terms. Include your full name, account email address, and a clear statement that you are opting out of the EdPathway arbitration agreement. Opting out does not affect the remaining Terms.

21.6 Court proceedings

Where arbitration does not apply, the parties consent to the exclusive jurisdiction of the state and federal courts located in Alameda County, California, except where applicable law gives you the right to bring a claim elsewhere.

22. Governing Law

These Terms are governed by California law, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs arbitration. Mandatory consumer-protection rights available in your place of residence remain unaffected.

23. Changes to These Terms

We may update these Terms to reflect changes to the Service, law, security practices, or business operations. We will post the updated Terms and revise the Last Updated date. For material changes, we may provide notice through the Service, by email, or another reasonable method, and may request renewed acceptance when appropriate. Changes apply prospectively from their effective date, except where law requires affirmative consent.

24. General Provisions

These Terms and the EdPathway Privacy Policy constitute the agreement concerning EdPathway, except for additional terms presented for a particular resource, paid feature, or service. They do not replace separate terms governing YoungWonks classes or other Wonksknow services unless expressly stated.

If a provision is invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without written permission. We may assign them in connection with a merger, acquisition, reorganization, financing, sale of assets, or transfer of the Service. Headings are for convenience only.
